[ARCHIVED] Brookings Court Failure to Appear Fine Doubling

Brookings Municipal Court hears traffic and municipal code violation cases once a month at Brookings City Hall. Those cited into court are cautioned to either pay the fine before the court date or to appear in court in order to avoid more costly fines and court fees.

Judge Richard Harper has signed an order that provides, beginning August 1, 2017, those failing to appear or failing to pay their fines prior to the court date will be found Guilty by Default, and all fines will double, the license will be sanctioned, and the account will be sent to collections with additional fees added.

The Oregon Revised Statutes allow a court to fine a person up to $2,000 for an “A” level violation such as Driving While Suspended which has a presumptive fine of $435. If the presumptive fine is not paid by the court date and if the individual fails to appear for an “A” violation, the presumptive fine then doubles to $870. An additional $25 Failure to Appear fee, a $24 License Sanction/Processing fee and a $25 Collection fee will also be added bringing the total to $945. The offender will also have to pay a $75 fee to the Oregon Department of Motor Vehicles to reinstate the license. Finally, the collection agency can also add an additional amount for collections.

Paying the fines before the court date or appearing in court to plead the case with the judge is the only way to avoid expensive additional fines and fees. For questions regarding citations, call the Municipal Court at 541-469-1114.
